Buyer acknowledges that most but not all products have not been tested by the supplier for safety and efficacy in food, drug, medical device, cosmetic, commercial, or any other use. Buyer represents and warrants that they will properly test and use any products purchased from Far West Chemicals in accordance with the practices of a reasonable expert in the relevant scientific field and in compliance with all applicable state and federal laws and regulations. Buyer further warrants that any materials produced with products from Far West Chemicals will not be adulterated or misbranded under the Federal Food, Drug, and Cosmetic Act and will not be materials that may not be introduced into interstate commerce under Sections 404, 505, or 512 of the Act. Buyer acknowledges that the products may not be listed on the Toxic Substances Control Act (TSCA) inventory, unless otherwise stated. Buyer assumes responsibility for ensuring that the products purchased from Far West Chemicals are approved for use under TSCA, if applicable. Buyer is responsible for verifying the hazards and conducting further research on the products' hazards. Buyer also has a duty to warn their customers and any auxiliary personnel of the risks associated with using or handling the products. Buyer agrees to comply with any instructions provided by Far West Chemicals regarding product use and to not misuse the products in any way. Buyer agrees that all products and services offered are for laboratory and research activities only. By placing an order with Far West Chemicals, the buyer understands that these chemicals and materials should never be used inappropriately. The products are not intended for recreational use or human consumption. All customers are expected to be qualified researchers.
